Apparently the settlement that has not actually been finalized is a big win for the banks and a no win for homeowners.  This article from Foreclosure Defense Nationwide gives a few of the details as to how the home owners are actually getting shafted again.  The money that will be available is already being ear marked to help fill the holes in state budgets rather than be used to help and protect homeowners.  It is unbelievable what the banks have pulled off again and how they have gotten away with so much criminal activity.  So much for government protection.  

We have been receiving literally dozens of e-mails from homeowners inquiring as to what effect the bank settlements with various attorneys general will have on their foreclosure cases. Answer: NONE, for several reasons.
First, the Attorney General claims were just that: claims by attorneys general against the banks. Private litigants were not parties to the litigation, so they are not parties to any settlement. In fact, it has already been reported that the settlements have no effect on and do not preclude an individual pursuing legal relief against a lender.
Second, the settlements are not even finalized yet. They have to be filed in court, and once they are, the states which filed the lawsuits will be free to enact whatever procedures, processes, requirements, etc. they wish as to whether a homeowner “qualifies” for any settlement proceeds. As we all know from the loan mod scam, this process can take months or even years, and there are a million ways that a homeowner can be found to ultimately not “qualify”.
Third, and perhaps most revolting and insidious, is that several of the states have ALREADY announced that portions of the settlements will be diverted to state budgets. Specific instances include Wisconsin’s announcement that it plans to use $25.6 million of the settlement money to “plug holes in the state’s budget”, while Missouri has announced that it plans to put $40 million of the settlement money into the state’s “general fund”.

So, once again, the homeowners get nothing. In fact, it has been separately announced that because the attorney general lawsuits have been resolved that the banks will be ramping up individual foreclosures, obviously now because they will not have state governments and attorneys general examining what they do. Sad, but unfortunately true.

This story of the banking criminal activity just continues to unfold and it is becoming more and more unbelievable as the evidence to support massive bank fraud and criminal activity is finally seeing the light of day.  In that sense the story is playing out just as most people who knew the truth thought it would play out.  What is the truth?  The truth is that banks have egregiously committed fraud and other criminal activity for their own gain and to try and purposefully break the law and beat the system.  The real crazy thing is that the government seems to be okay with the massive lies and law breaking that has been going on by the major bank players.  It is disgusting and appalling to see the government try to brush such a massive abuse of the American taxpayer under the rug for the sake of political gain.  It is becoming more and more clear every day that the banking industry screwed just about every home owner in the country to some degree and they knew they were doing it.  Now we are seeing why they felt no shame in doing so as they have gotten away with what could be seen as the banking industry's rendition of the prefect murder.  However, it is only perfect because the politicians and current administration are in the tank for the too big to fail banks.  It is a shame that the failure of our "democracy" has to be revealed with the systematic wiping out of trillions of dollars of wealth.

We’ve reported repeatedly of widespread evidence of grotesque procedural abuses as servicers and foreclosure mill lawyers try to cover up for the fact that in many cases, mortgage notes were not transferred properly to securitization trusts, and the rigid way these deals were structured makes it impossible to remedy those failures at this juncture. Absent creating a time machine, the only fix is to fabricate documents that make it appear than things were done correctly. We’ve seen (as in in person) obvious forgeries submitted to the court (signatures obviously Photoshop shrunk to fit) and servicer personnel caught perjuring themselves, yet judges are remarkably unwilling to issue a ruling that hinges on finding that the plaintiff filed phony documents.
If this case moves forward, that reticence may change. Note that this case, which covers only the Central District of California, alleges that Chase engaged in over 7000 filings of motions of relief of stay in bankruptcy court using fabricated documents. Remember that filing for bankruptcy puts a “stay” or hold, on all creditor claims. They all go wait while the court determines which creditors get what from the under water borrower. A “motion for relief of stay” by a mortgage lender is tantamount to saying, “Judge, let me grab the house.” Motions for relief of stay are typically a costly nuisance for bankruptcy lawyers. It wastes the borrower’s scarce money to shoo them away (and some plaintiffs’ lawyers will take advantage of inexperienced bankruptcy lawyers by getting them to sign a waiver in return for dropping the motion for relief of stay that looks innocuous but has a paragraph in it changes the burden of proof from the bank to the borrower, which almost always puts them at a fatal disadvantage and results in the loss of the home).

Mayweather Oritiz fight seems worse after thinking it over

I am still in a bit of shock after watching the Mayweather Ortiz fight last night.  It was like watching a completely staged WWE fight where the referee is made out to look like a fool.  The cheap shots by Mayweather that were clearly not seen by the ref should not have lead to the stoppage of the fight unless it was to award the fight to Ortiz.  The ref made the signal for a time out with his hands and made it very clear the fight was stopped.  Mayweather was taking cheap shots while the ref wasn't looking and it was seen clearly as he looked toward the ref before he landed the first left and then the straight right to the face of a completely defenseless Ortiz.  The ref did not tell the fighters to continue with the fight, the fight was stopped and the referee looked like a puppet when he turned and started the 8 count when fight was still on time out.  Ortiz didn't deserve to go out this way even after the head butt.  It was a foolish thing for him to do but it didn't hurt Mayweather badly and certainly would not have had an effect on the fight. 
This was a fight that will go down as one more of boxing infamous moments that had so tarnished the reputation of the sport.  The boxing commission should take the win away from Mayweather and at least call it a draw.  It was not a win and it was not an official fight.  It was just starting to shape into a reasonable fight after the first 3 rounds but the sucker punches from Mayweather did not reveal a true champion. 

Boxing has become more spectacle than profession and it is all about the money.  Mayweather should not have gotten paid for that fight and he should have been fined for not following the referees orders and hitting a defenseless fighter.  The type of injuries that cause severe concussions and brain injuries are even more likely to happen when someone is completely defenseless while being blindsided by their opponent.  It is a shame all around.  I know the boxers got paid, the referee got paid, HBO got paid but the fans got screwed as did the entire sport of boxing.
